Welcome to Zyn Data's technology ecosystem.

This document defines the legal rights and obligations between Zyn Data and Customers using the services.

These Terms apply uniformly to all services and sub-brands under Zyn Data.

By registering and using any service, the Customer is deemed to have fully agreed to comply with the Terms below.

  • These general Terms of Service.
  • Service-specific regulations for each package (if applicable).

I. LEGAL REGULATIONS AND CONDUCT

Article 1. Compliance with Law and Purpose of Use

Customer commits to using the services only for lawful purposes. Zyn Data strictly prohibits and may unilaterally terminate the contract immediately, without refund, for the following acts:

  • Prohibited content: Storing or distributing obscene materials, pornography, social vice content, illegal gambling, or betting content.
  • Cybercrime: Conducting cyberattacks (DDoS, Botnet), distributing malicious software (Virus, Malware, Ransomware), phishing, or unauthorized vulnerability scanning originating from Zyn Data infrastructure.

Article 2. Account Security and Identification (KYC)

  • 1. Registration information: Customer must provide accurate, complete, and updated information (Email, Phone Number, Full Name). Zyn Data may request identity verification (KYC) using legal identification documents (ID Card/Passport) when unusual activity or account disputes are detected.
  • 2. Security: Customer bears full responsibility for securing login credentials (Username, Password, SSH Key). Zyn Data is not liable for any loss arising from Customer disclosure of access credentials to third parties.
  • 3. "One account" policy: Creating multiple accounts (clones) to exploit promotions is strictly prohibited. Zyn Data reserves the right to permanently lock violating accounts.

Article 3. Resource Abuse Policy

  • 22. Bug/Resource Exploitation: Any exploitation of system bugs or abuse of resources within Zyn Data infrastructure (including but not limited to: CPU, RAM, Disk I/O, Bandwidth, Network) for profit or affecting shared infrastructure will result in immediate service suspension upon Zyn Data detection, without prior notice.
  • 23. Support Limitation - Proxy/Relay: Zyn Data does not guarantee connection quality (latency, speed, stability) and does not prioritize technical support for services (Physical Servers, Game Hosting, VPS) within Zyn Data infrastructure when found being used as intermediary proxy, DDoS absorbing proxy, or connecting external proxies to backend within Zyn Data infrastructure.

II. PAYMENT AND FINANCE

Article 4. Payment Regulations

  • 4. Payment term: Services operate on a prepaid model. Customer must pay 100% of the service fee before activation or renewal.
  • 5. Payment methods: Accepted methods include bank transfer, e-wallet, online payment gateway, or prepaid card (subject to current card processing fee policy).
  • 6. Tax: Listed prices on the website may exclude VAT. Business customers requesting VAT invoices should contact accounting and pay an additional 10% VAT.

Article 5. Late Payment and Renewal

  • 7. Suspend: Services will be automatically suspended if unpaid within 01-03 days after expiration.
  • 8. Terminate: If overdue for 03-07 days (depending on service type), the system will automatically cancel the service and permanently delete data to release resources. Zyn Data is not responsible for data loss caused by late payment.

Article 6. General Refund Policy

  • 9. Principle: Zyn Data is committed to refund handling to protect customer rights. This policy applies to all orders and all customers using services under Zyn Data.
  • 10. Golden period: 90% of service value is refundable within the first 03 days if the issue originates from the provider or the service does not match commitments. The refund amount is added as account credit in Zyn Data's system.
  • 11. After the golden period: Refunds are subject to administrative fees and deduction based on days used. (Fee details are specified on the payment page or service-specific terms).
  • 12. Exceptions - non-refundable cases: Domain names, software licenses, dedicated servers, customers violating these Terms, services identified as being used as a proxy/relay to absorb or distribute external DDoS attacks (based on traffic logs from Zyn Data monitoring systems), or any funds already deposited into the service account balance (account credit) at Zyn Data.

Important: All refund requests must be submitted through the official Ticket system within the allowed period. Zyn Data does not process refund requests via social media.


III. DATA AND TECHNICAL RESPONSIBILITY

Article 7. Data Ownership and Backup

  • 13. Ownership: Data stored on servers belongs to and remains the legal responsibility of the Customer. Zyn Data does not interfere with customer data unless required by competent authorities.
  • 14. Backup responsibility (IMPORTANT): Although Zyn Data implements system redundancy mechanisms (RAID), Customer is required to proactively perform periodic backups to personal devices or secondary storage locations.
  • 15. Data liability disclaimer: Zyn Data is not liable for data compensation in cases of force majeure hardware failure, natural disasters, accidental deletion by Customer, or service cancellation due to violations/expiration.

Article 8. Service Commitment (SLA) and Support

  • 16. Uptime: Best-effort commitment to maintain monthly system uptime at 99% (excluding notified scheduled maintenance).
  • 17. Support channels: Official support is provided via Ticket system, Email, and Hotline. Social media channels are for initial contact only.
  • 18. Support scope limits: Zyn Data supports infrastructure, network, and hardware-related issues. Support for third-party software installation, web code configuration, or advanced game server setup depends on each service package policy.

Article 9. Fair Use Policy

Customers share infrastructure with other users; therefore, resource abuse that affects shared system stability is strictly prohibited:

  • 19. Hardware abuse: Continuously running resource-exhaustive workloads on standard Hosting/VPS plans (such as crypto mining or heavy rendering).
  • 20. Network abuse: Using Zyn Data infrastructure as a public Proxy/VPN, operating unauthorized Anti-DDoS services (without specialized Reseller plans), or intentionally attracting DDoS attacks from external parties.
  • 21. Automated DDoS incident handling (Emergency suspension): If monitoring systems detect that Customer service is a target or source of DDoS traffic exceeding allowed thresholds and affecting shared infrastructure, Zyn Data may immediately suspend the service to protect the system and other customers. To reactivate, Customer must directly contact Zyn Data Technical Support via Ticket or Hotline to coordinate mitigation, verify root cause, and commit corrective measures. Zyn Data will not auto-reactivate services in this case.

Important: Emergency suspension due to DDoS does not constitute an SLA Uptime breach if the cause originates from external attacks targeting Customer services.


IV. ENFORCEMENT TERMS

Article 10. Force Majeure

Zyn Data is exempt from liability for performance obligations in events beyond reasonable control, including but not limited to: natural disasters, fires, wars, epidemics, large-scale submarine cable incidents, or prohibition/restriction decisions from State authorities.

Article 11. Dispute Resolution

All disputes shall first be resolved through negotiation and mediation in a spirit of cooperation. If no agreement is reached, disputes shall be brought before the competent People's Court in Dong Nai Province. The Court's decision is final.

Article 12. Amendment of Terms

Zyn Data reserves the right to revise or supplement this Agreement at any time to comply with legal regulations and business conditions. Revised content takes effect immediately upon public posting on Zyn Data's website system and sub-brand websites. Continued use of services after updates means Customer accepts those changes.
